Does the Constitution Apply to Non-Citizens — Even Illegals?
Yes — and not because of opinion, but because of how it’s written.
The U.S. Constitution protects “persons,” not just “citizens.”
That’s why undocumented immigrants are still guaranteed things like:
Due Process (5th & 14th Amendments)
Equal Protection under the law
Freedom from unlawful search or indefinite detention
But — voting, gun rights, federal benefits, and legal status are NOT included.
This has been upheld by the U.S. Supreme Court, including landmark cases like Plyler v. Doe (1982) and Zadvydas v. Davis (2001).

JSA2026 Stands Firm:
“We believe in the Constitution — but it’s time we stop letting it be used to give illegal entrants privileges over American citizens. I’ll defend due process — but I’ll end undue privilege.”
